I'm about to drive myself crazy thinking about this. So I thought I'd see if any of you have had any experience in this area.

I've made a couple of posts about the noises and rattles I have. Some of you may have even seen my last update on it. If not, I've taken my truck in twice for noises and they still can't figure out where they coming from. So now they have contaced Nissan Corporate and they are sending an engineer out to investigate. They've told me that if he can't find them, then Nissan is going to buy my truck back because they've tried twice now ... a week each time. I'm still waiting to find out when I get to take it in.

My question is, when will the engineer decide that he can't find the main one either. Will he dismantle my truck piece-by-piece until he does find it? Or will he try to use the same methods that the technician used? And how long will he try? In my mind, if he's going to dismantle it then I don't want it back because it'll never be the same after it's been taken apart.

Right now I think the odds are in my favor because there are two other noises he's got to find as well.

I figure they will make more money if they buy it back, let me upgrade, fix the problem and then sell it again.

Any thoughts?

I don't know what the rules are in my state, so I am not going to guess what they are in your state, but I would suggest reading up on your states Lemon Law.  I know a few states also provide an attorny with the monies collected when a new vehicle is purchased.  If your vehicle has been kept from you for a certain number of hours or a certain number of fixes, they are legally obligated to purchase the vehicle.  I would try to have them buy it back now and they can search the sounds on their time and their truck.

Best of luck!

Ron

I've read the Lemon Law for Texas (where I live) quite a few times now, but it doesn't mention what rights they have or don't have to find the problem. The number of trys has gone up from 3 to 4, but my service advisor told me they would have to buy it back if he doesn't find it. I wasn't about to argue with him.

I did realize something this evening though. He told me that they weren't going to give me a reciept for this past visit. I didn't think anything about it then, but I think they are trying to make it look like I've only taken it in twice, when this next visit will be the third. I'm going to have to confront them on that. If they won't give me a receipt I guess it'll get nasty!

I think I signed an agreement for 3rd party arbitration when I bought the truck..if I did it was only because they told me I had to...luckily I havent had any major problems....1 question though...as aggrivating as rattles and squeaks are, do you think that the Lemon law would really apply to that? If you had asked me, I prolly would have said that the Lemon law would only apply to mechanical problems... ie. engine, tranny, or electrical....GL

Hello again. you migh ask yourself if rattles and whatever else are acceptable when you purchase a new vechicle.I would talk to a lawyer if you dont get satisfaction, and also check the magnuson moss act also. good luck

Well, my rattle would probaby be better classified as a popping noise. And it is coming from the chassis somewhere. I was reading something that said each year manufacturers buy back over 100,000 vehicles with problems ranging from the unsafe to the annoying. Which means, it doesn't matter what the problem is, if they can't find it within 4 attempts, within so many miles, they are required to give you your money back. If the problem makes the vehicle unsafe they only have 2 attempts. And ... from what I understand, if they can't find the problem without dismantling many pieces, then they will buy it back in order to dismantle it piece-by-piece to pinpoint the problem, and go straight to the source the next time it arises.

This is my third attempt, and they specifically said that if the engineer can't find the rattle then they will buy my truck back. So I shouldn't even have to worry about the arbitration ... hopefully.

Supposedly they are looking at me taking it in early next week ... I'm supposed to find out today. Hopefully I will know the final outcome by the end of next week.

I keep you updated.
